This Legal Disclaimer is intended to be read together with resqme, Inc.'s Terms & Conditions, Refund & Return Policy, Privacy Policy, product instructions, warnings, packaging, manuals, and any other written guidance supplied with or displayed for a product. By accessing resqme.com, purchasing a product, opening product packaging, testing a product, using a product, gifting a product, or allowing another person to use a product, you acknowledge and accept this Disclaimer to the maximum extent permitted by applicable law.
1. Scope of This Disclaimer
This Legal Disclaimer applies to all websites, online stores, product pages, product listings, advertisements, educational materials, demonstrations, communications, products, accessories, kits, replacement parts, bundled items, and third-party supplied items offered, sold, distributed, promoted, or made available by resqme, Inc. ("resqme," "Company," "we," "us," or "our"), including through resqme.com and any related sales channel.
For purposes of this Disclaimer, "Products" means all items sold or distributed by resqme, including, without limitation, the resqme® car escape tool, Whistles for Life®, car escape training kits, demo kits, tempered-glass training materials, seatbelt training materials, personal safety alarms, drowsy-driver devices, hammers, accessories, bundles, and any other consumer, emergency, survival, training, or safety product.
2. Emergency-Use Products; No Guarantee of Rescue, Survival, or Injury Prevention
resqme Products are intended to support emergency preparedness and personal-safety planning. They are not a guarantee of rescue, survival, successful escape, injury prevention, property protection, or emergency response. No Product can eliminate the risks associated with vehicle collisions, entrapment, submersion, fire, rollover events, mechanical failure, panic, impaired visibility, difficult access, improper placement, defective vehicle components, laminated glass, user error, user incapacity, or any other emergency condition.
You are solely responsible for reading, understanding, storing, maintaining, testing only as instructed, and using each Product in accordance with all applicable instructions, warnings, laws, and common-sense safety practices. You should not rely on any Product as a substitute for safe driving, seatbelt use, emergency planning, professional training, supervision of minors, compliance with traffic laws, or contacting emergency services when needed.
3. Proper Use; Directions Must Be Followed
The resqme® safety tool is specifically designed for emergency use only. The spring-loaded spike is designed for auto tempered glass. Do not test or press the spike against hard surfaces such as metal, wood, rock, tile, concrete, ceramic, stone, ordinary household objects, body parts, animals, or any other surface not expressly identified by resqme as appropriate for testing. Improper testing or impact may dull, damage, misalign, or otherwise compromise the spike or the Product.
The seatbelt cutter is a concealed cutting blade designed for emergency seatbelt-cutting use. Do not place fingers, skin, clothing, hair, cords, straps not intended for cutting, or other body parts into the cutting channel. Do not allow children to handle any Product unless supervised by a responsible adult and only in a manner consistent with all warnings and instructions.
4. Tempered-Glass Demonstration Kits and Training Materials
Certain Products or bundles may include a car escape training kit, demonstration kit, tempered-glass samples, glass circles, seatbelt materials, or other training components. These materials are provided solely for controlled educational and demonstration purposes. They are not toys, are not recreational items, and must not be used carelessly, aggressively, competitively, or without appropriate safety precautions.
Tempered glass may shatter abruptly and may produce fragments, chips, dust, sharp edges, or projectile particles. Any person who opens, handles, stores, transports, tests, breaks, cleans, disposes of, or observes use of a demonstration kit assumes the risks associated with glass breakage, sharp objects, cutting tools, and emergency-device testing, including cuts, punctures, eye injury, skin injury, inhalation of particles, property damage, and other bodily harm.
Users of any demonstration kit must, at a minimum:
- wear appropriate eye protection, gloves, long sleeves, closed-toe shoes, and other protective equipment suitable for broken glass;
- conduct demonstrations only in a controlled area away from children, pets, bystanders, vehicles, food, walkways, and fragile property;
- use a stable containment surface, drop cloth, tray, shield, or other protective barrier capable of containing fragments;
- avoid using the kit while impaired, distracted, hurried, angry, fatigued, or physically unable to control the Product;
- collect and dispose of all fragments immediately and safely using tools appropriate for broken glass; and
- cease use immediately if any Product, glass sample, or training material appears cracked, defective, altered, damaged, contaminated, or unsafe.
resqme is not responsible for injuries, property damage, clean-up costs, medical costs, disposal costs, or any other losses arising from handling, testing, breaking, demonstrating, storing, or disposing of tempered glass or any other training-kit component, except to the extent liability cannot be excluded under applicable law.
5. Misuse, Illegal Use, Nefarious Use, and Prohibited Conduct
Products must be used only for lawful, responsible, emergency, safety, educational, or preparedness purposes. resqme does not authorize, encourage, endorse, or accept responsibility for any misuse, abusive use, criminal use, vandalism, theft, trespass, harassment, assault, property damage, intimidation, self-harm, prank, stunt, social-media challenge, unauthorized vehicle entry, or other wrongful use of any Product.
Any person who uses a Product for an improper, unlawful, nefarious, self-injurious, reckless, or prohibited purpose does so solely at that person’s own risk and responsibility and agrees to indemnify and hold resqme harmless from all resulting claims, losses, damages, fines, penalties, costs, attorneys’ fees, and liabilities to the maximum extent permitted by law.
6. Self-Harm, Threats, and Unsafe Behavior
Products are not intended for self-harm, threats, coercion, intimidation, violence, or any other unsafe behavior. If you are considering self-harm or harming another person, do not use any Product. Seek immediate help from emergency services or a qualified crisis resource. resqme disclaims responsibility for any injury, death, or loss arising from intentional self-harm, attempted self-harm, reckless conduct, misuse, or use of Products contrary to their intended emergency-safety purpose, except where such disclaimer is prohibited by law.
7. Product Function, Environmental Conditions, and Emergency Limitations
Emergency conditions are unpredictable. Product performance may be affected by, among other things, user strength, access, hand position, panic, injury, darkness, water pressure, vehicle design, glass type, window tinting, laminated glass, aftermarket films, product age, storage conditions, prior misuse, contamination, corrosion, physical damage, maintenance history, manufacturing tolerances, and circumstances beyond resqme’s control.
The resqme® car escape tool is designed for auto tempered glass and is not represented as suitable for every type of automotive glass, laminated glass, windshield glass, architectural glass, reinforced glass, plastic glazing, or other materials. Users are responsible for understanding their vehicle and for placing emergency tools where they are accessible when needed.
resqme does not warrant or represent that any Product will function in every emergency, in every vehicle, in every environment, after misuse, after damage, after improper storage, after unauthorized modification, or after use inconsistent with instructions.
8. Third-Party Products, Components, and Suppliers
Except for Products expressly identified by resqme as manufactured by or for resqme in the United States, certain Products, components, accessories, bundles, or related items may be sourced, manufactured, assembled, packaged, fulfilled, developed, modified, or supplied by third-party suppliers, manufacturers, distributors, logistics providers, or service providers. resqme may curate, resell, bundle, private-label, or distribute third-party products, but such activity does not make resqme responsible for all acts, omissions, representations, instructions, warnings, designs, materials, defects, delays, or failures of third parties, except to the extent required by applicable law.
9. No Professional, Medical, Safety-Engineering, or Emergency-Response Advice
Website content, product descriptions, videos, demonstrations, blogs, emails, social-media content, packaging, and other materials are provided for general informational purposes only. They do not constitute medical advice, legal advice, engineering advice, first-responder training, vehicle-safety certification, professional rescue instruction, or a substitute for emergency services. Users should seek appropriate professional guidance where circumstances require it.
10. Assumption of Risk
To the maximum extent permitted by law, you knowingly and voluntarily assume all risks arising from or related to accessing the website, purchasing Products, selecting Products, relying on Product information, opening packaging, storing Products, testing Products, using Products, permitting others to use Products, demonstrating Products, reselling Products, gifting Products, transporting Products, disposing of Products, or using any Product in an emergency or non-emergency situation.
11. Limitation of Liability
To the maximum extent permitted by applicable law, resqme, its owners, officers, directors, employees, contractors, suppliers, distributors, affiliates, agents, successors, and assigns shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, enhanced, or similar damages; lost profits; loss of use; property damage; personal injury; death; business interruption; loss of goodwill; data loss; emergency-response failure; rescue failure; vehicle damage; glass-related injury; medical expense; or any other loss arising from or relating to the website or Products, whether based in contract, tort, strict liability, negligence, warranty, statute, or any other theory, except to the extent such limitation is prohibited by applicable law.
Nothing in this Disclaimer is intended to exclude liability that cannot lawfully be excluded, including liability that may arise under non-waivable consumer-protection, product-liability, or personal-injury laws. The limitations in this Disclaimer apply only to the maximum extent permitted by law and shall be interpreted to preserve their enforceability.
12. No Waiver of Required Consumer Rights
Some jurisdictions do not permit certain exclusions, disclaimers, or limitations of liability. In those jurisdictions, the limitations in this Disclaimer apply only to the fullest extent permitted by law. This Disclaimer does not waive any rights that cannot be waived by contract.

resqme may update this Disclaimer from time to time. The version posted on resqme.com or otherwise provided by resqme will govern from its stated effective date. Continued use of the website, purchase of Products, or use of Products after an update constitutes acceptance of the updated Disclaimer to the maximum extent permitted by law.
