Warranty Area Policy Rule

Limited Warranty Term

Products purchased directly from resqme, Inc. include a one (1) year limited product warranty unless a different written warranty period is expressly stated for a specific product.

Proof of Purchase Required

Warranty coverage is valid only upon producing acceptable proof of purchase, such as a receipt, invoice, order confirmation, or other purchase record accepted by resqme, Inc.

Covered Defects

The warranty covers qualifying defects in materials or workmanship under normal, intended, lawful, and instruction-compliant use.

Evidence May Be Required

Before approving any warranty replacement, resqme, Inc. may require photo or video evidence, product information, packaging information, order information, serial/lot information where applicable, and/or return of the item for inspection.

Misuse Voids Warranty

The warranty is void if the product is damaged by misuse, abuse, improper testing, poor storage, improper maintenance, neglect, intentional manipulation, alteration, unauthorized repair, or use outside product instructions.

resqme Tool Glass Limitation

Attempting to use a resqme® car escape tool on any material other than automotive tempered glass — including metal, wood, rock, laminated glass, windshields, or other hard surfaces — may damage the tool and void the warranty.

Children Warning

KEEP OUT OF REACH OF CHILDREN. Products may include sharp, spring-loaded, breakaway, small, or otherwise hazardous components and must be stored responsibly.

1. Purpose and Scope

This Warranty Policy governs the limited product warranty provided by resqme, Inc. for products purchased directly from resqme, Inc. through resqme.com or another sales channel operated by resqme, Inc. This Policy is incorporated by reference into resqme, Inc.’s Terms & Conditions, Shipping & Return Policy, product instructions, safety warnings, and any product-specific documentation supplied with the applicable item.

This Warranty Policy applies to all products sold by resqme, Inc. unless a product-specific written warranty expressly provides different terms. Where a product-specific warranty conflicts with this Policy, the more specific written warranty controls only for that product and only to the extent of the conflict.

2. One-Year Limited Product Warranty

2.1 Warranty Term

Your purchase includes a one (1) year limited product warranty. The warranty period begins on the date of purchase shown on the customer’s valid receipt, invoice, order confirmation, or other proof of purchase accepted by resqme, Inc. If the purchase date cannot be verified, resqme, Inc. may deny warranty coverage or determine the warranty period using available order, shipment, manufacturing, lot, serial, or customer-service records.

2.2 What the Warranty Covers

Subject to all exclusions and conditions in this Policy, the limited warranty covers qualifying defects in materials or workmanship that arise under normal, intended, lawful, instruction-compliant use of the product during the applicable warranty period. This warranty does not guarantee that a product will prevent injury, death, property damage, loss, entrapment, theft, emergency escalation, or any other adverse outcome.

2.3 Exclusive Warranty Remedy

If resqme, Inc. determines that a product is covered by this limited warranty, resqme, Inc.’s sole obligation and the customer’s exclusive remedy will be, at resqme, Inc.’s discretion, repair, replacement, substitution with a comparable item, store credit, or refund of the purchase price paid for the covered product. resqme, Inc. may use new, refurbished, functionally equivalent, or successor products or components for warranty replacements where permitted by law.

3. Proof of Purchase and Claim Requirements

3.1 Proof of Purchase Required

Warranty coverage is valid only upon producing acceptable proof of purchase. Acceptable proof may include a receipt, invoice, order confirmation, packing slip, transaction record, or other purchase documentation sufficient for resqme, Inc. to verify the product, purchase date, sales channel, and customer order.

3.2 Information Required for a Warranty Claim

To submit a warranty claim, the customer may be required to provide:

  • Customer name, contact information, order number, and purchase date.
  • Product name, quantity, color, style, kit configuration, serial number, lot number, batch information, or packaging details where applicable.
  • A clear description of the alleged defect, when it was discovered, and how the product was used, stored, maintained, handled, or tested.
  • Photo or video evidence showing the alleged defect, the full product, relevant packaging, components, accessories, and proof of purchase.
  • Any other information reasonably requested by resqme, Inc. to evaluate warranty eligibility, product condition, product authenticity, safe handling, and claim validity.

3.3 Inspection Before Replacement

resqme, Inc. may require photo evidence, video evidence, and/or return of the product before approving any replacement, refund, credit, repair, or other warranty remedy. A requested replacement is not approved merely because a customer submits a claim. Coverage is determined only after resqme, Inc. has reviewed the available evidence and, where required, inspected the returned item.

3.4 Returned Item May Be Required

resqme, Inc. may require the customer to return the allegedly defective item, packaging, parts, accessories, inserts, and related materials for inspection. If resqme, Inc. requests return of the item and the customer fails to return it within the time and manner requested, resqme, Inc. may deny the warranty claim. Unauthorized returns may be rejected, delayed, or returned to sender.

4. Warranty Exclusions and Void Conditions

This limited warranty does not apply, and warranty coverage is void, where the product condition or failure is caused by or associated with any excluded circumstance, including without limitation:

  • Misuse, abuse, negligent use, reckless use, unlawful use, improper testing, or use inconsistent with product instructions, product labeling, safety warnings, or intended purpose.
  • Poor storage, improper storage, exposure to excessive heat, cold, moisture, water, chemicals, corrosive substances, direct sunlight, crushing, pressure, vibration, impact, unsanitary conditions, or other unsuitable storage or environmental conditions.
  • Poor maintenance, failure to inspect or maintain the product, failure to keep the product clean and dry where applicable, failure to replace damaged parts, or continued use after suspected damage or malfunction.
  • Intentional manipulation, alteration, disassembly, modification, tampering, attempted repair, unauthorized service, reverse engineering, cosmetic customization, or interference with any product component, spring, blade, housing, clip, guard, mechanism, whistle, attachment, packaging, or safety feature.
  • Accidental damage, impact damage, crushing, breakage, dropping, bending, cutting, contamination, ordinary wear and tear, cosmetic wear, scratches, discoloration, fading, or damage occurring after delivery.
  • Use for self-harm, assault, vandalism, theft, property damage, coercion, unlawful entry, malicious conduct, prank use, unsafe demonstrations, or any nefarious, reckless, or illegal purpose.
  • Use by or access by children, minors, or unauthorized persons, including damage, injury, or loss caused by failure to keep products out of reach of children.
  • Damage caused by third-party products, accessories, tools, chargers, fixtures, kits, glass, training materials, packaging, storage devices, or environments not supplied or expressly authorized by resqme, Inc.
  • Counterfeit products, gray-market products, resale products without acceptable proof of purchase, products purchased from unauthorized sellers, or products for which authenticity cannot be verified.

5. Product-Specific Conditions for the resqme® Car Escape Tool

5.1 Emergency Use and Tempered Glass Limitation

The resqme® car escape tool is designed for emergency use on automotive tempered side windows, consistent with the product instructions and warnings. Attempting to use the resqme® tool on any material besides automotive tempered glass may damage the tool, create unsafe conditions, and void the warranty.

Without limitation, use or attempted use of the resqme® tool on metal, wood, rock, concrete, ceramic, laminated glass, windshield glass, household glass, display glass, mirrors, tables, bottles, screens, or any other hard or non-approved surface is misuse and may void warranty coverage.

5.2 Improper Pulling, Excessive Force, and Clip Guard Damage

Improper use of the resqme® tool, including using excessive force to pull down, separate, release, twist, pry, snap, or detach the tool from its clip or guard, may cause the clip guard or related components to break and will void the warranty where resqme, Inc. determines the damage resulted from improper handling, excessive force, or misuse rather than a covered defect.

5.3 Testing and Demonstration Risks

Customers must not test the resqme® tool on unapproved surfaces. Customers who purchase or use any demonstration kit, training material, tempered-glass sample, seatbelt sample, or related testing accessory must follow all instructions and safety warnings. Damage, injury, glass breakage, cuts, punctures, flying fragments, contamination, or product failure caused by improper testing, unsafe demonstrations, inadequate protective equipment, or failure to control the testing environment is not covered by this warranty.

6. Products Purchased Through Retailers, Resellers, and Marketplaces

Products purchased through third-party platforms, retailers, marketplaces, distributors, or resellers - including Amazon, Walmart, REI, and any other non-resqme.com sales channel - may be subject to the return, refund, exchange, and warranty procedures of the original seller of record. Customers should first contact the applicable retailer, reseller, marketplace, distributor, or platform support team for orders not purchased directly from resqme, Inc.

resqme, Inc. may, in its discretion, request proof of purchase, seller information, marketplace order records, product photos, packaging photos, and authenticity information before evaluating a warranty claim for products purchased outside resqme.com. resqme, Inc. may deny coverage for products that cannot be verified as authentic, new, authorized, or within the warranty period.

7. Warranty Claim Review and Determination

resqme, Inc. reserves the right to approve, deny, partially approve, or condition any warranty claim based on the product condition, available evidence, inspection results, proof of purchase, purchase channel, product authenticity, claim timing, applicable exclusions, and compliance with this Policy.

Submission of a warranty claim does not guarantee replacement, refund, credit, repair, reimbursement, or any other remedy. resqme, Inc. may deny claims that are incomplete, unsupported, inaccurate, inconsistent, fraudulent, untimely, outside the warranty period, based on excluded damage, or otherwise noncompliant with this Policy.

8. Limitation of Warranty

To the fullest extent permitted by applicable law, this limited warranty is the exclusive written product warranty provided by resqme, Inc. and replaces all other warranties, representations, statements, promises, or remedies not expressly stated in this Policy. No employee, contractor, reseller, marketplace, distributor, retailer, agent, influencer, or other third party is authorized to modify this warranty or create additional warranty obligations for resqme, Inc. unless expressly approved in a written instrument signed by an authorized officer of resqme, Inc.

This warranty does not cover incidental, consequential, indirect, punitive, special, exemplary, or enhanced damages, including without limitation personal injury, bodily harm, death, emotional distress, property damage, loss of use, emergency response costs, lost profits, lost revenue, lost savings, replacement labor, travel costs, towing costs, vehicle damage, glass replacement, or other losses allegedly arising from product use, product failure, delayed use, inability to use the product, misuse, storage, maintenance, inspection, or warranty service, except where such limitation is prohibited by applicable law.

9. Safety Notice

KEEP OUT OF REACH OF CHILDREN. resqme, Inc. products may contain sharp, pointed, spring-loaded, breakaway, small, or otherwise hazardous components. Products must be stored, handled, maintained, and used responsibly and only in accordance with applicable product instructions and safety warnings. Customers are responsible for ensuring that products are not accessed, handled, tested, or used by children, unauthorized persons, or anyone unable to use the product safely.

10. Relationship to Other Policies

This Warranty Policy is separate from resqme, Inc.’s Shipping & Return Policy, Terms & Conditions, Legal Disclaimer, Privacy Policy, product instructions, safety warnings, and other applicable customer policies. A product may be ineligible for return or refund even if a warranty claim is submitted, and a warranty claim may be denied even if a return or refund request was previously considered. resqme, Inc. may apply each policy independently to the fullest extent permitted by law.
